Plain English Summary: SalesLead is a marketplace that connects homeowners with contractors. We are not a contractor, we do not perform work, and we are not responsible for the quality, safety, or outcome of any services. Contractors are fully responsible for their work. SalesLead ("the Platform," "we," "us," or "our") operates as an online marketplace that facilitates introductions between homeowners seeking home services ("Homeowners") and independent contractors and tradespeople ("Contractors"). SalesLead is not a contractor, does not perform any home services, and is not a party to any service agreement between Homeowners and Contractors.
Contractors using SalesLead are independent businesses or individuals, not employees, agents, or representatives of SalesLead. SalesLead does not supervise, direct, control, or monitor any Contractor's work. Nothing in these Terms creates any employment, partnership, joint venture, franchise, or agency relationship between SalesLead and any user.
SalesLead does not guarantee, warrant, or make any representations regarding the quality, safety, suitability, reliability, timeliness, or legality of services provided by any Contractor. SalesLead does not verify Contractor licenses, insurance, bonding, certifications, or backgrounds unless explicitly stated. Homeowners assume all risk in selecting and hiring a Contractor.
To the maximum extent permitted by applicable law, SalesLead shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to: (a) any services performed or not performed by a Contractor; (b) any damage to property caused by a Contractor; (c) personal injury arising from Contractor work; (d) disputes between Homeowners and Contractors; or (e) any reliance on information provided through the Platform.
SalesLead's total liability to any user for any claim shall not exceed the fees paid by that user to SalesLead in the 30 days preceding the claim.
By creating an account, Contractors represent and warrant that they are operating as an independent business or sole proprietor, hold all required licenses and permits for their trade and jurisdiction, carry appropriate insurance (including general liability and, where required, workers' compensation), and comply with all applicable laws and regulations.
Contractors are solely and fully liable for all work performed, including any damage to property, injury to persons, failure to complete work, substandard workmanship, or any other harm resulting from their services. By agreeing to these Terms, Contractors acknowledge that SalesLead bears no liability for the outcome of any work performed and that all claims arising from the work must be directed solely to the Contractor.
In the event a Contractor causes damage to a Homeowner's property, fails to complete agreed work, performs work that does not meet professional standards for the trade, or engages in any act of negligence, the Contractor shall be solely responsible for all resulting costs, repairs, and damages. The Contractor agrees to indemnify and hold harmless SalesLead from any claims, losses, or expenses arising from the Contractor's acts or omissions.
Contractors agree to perform all services in a professional manner consistent with industry standards for their trade, provide accurate quotes and timelines, communicate clearly with Homeowners, and complete all work as agreed. Contractors who receive multiple verified complaints may be suspended or permanently removed from the Platform.
Contractors agree not to misrepresent their qualifications, experience, licensing status, or business identity when using the Platform or contacting Homeowners.
Homeowners agree to provide accurate and truthful descriptions of the work needed, including scope, location, timeline, and budget. Misrepresentation of a job scope may result in removal from the Platform.
Homeowners agree to pay the Contractor in full for services rendered, provided that: (a) the work has been completed as described in the agreed scope; (b) the work meets reasonable professional standards for the trade; and (c) no material defects exist that the Homeowner has documented and brought to the Contractor's attention within 72 hours of completion.
Refusal to pay for qualifying completed work without documented justification is a violation of these Terms and may result in the Homeowner being reported to relevant consumer protection bodies and barred from the Platform.
If a Homeowner believes work was not completed to standard, they must: (1) notify the Contractor in writing within 72 hours of completion; (2) provide specific documented evidence of the deficiency; and (3) allow the Contractor a reasonable opportunity to remedy the issue before withholding payment. SalesLead may, at its discretion, assist in mediation but is not obligated to do so.
SalesLead is not responsible for and will not provide refunds for Contractor non-performance, abandonment of work, or disputes. Any claims must be made directly against the Contractor. SalesLead encourages all users to obtain written contracts directly with Contractors before work begins.
All payments made through SalesLead are subject to a payment processing fee of 2.9% + $0.30 per transaction, charged by our third-party payment processor (Stripe). This fee is passed through to the paying party and will be displayed as a separate line item at the time of payment. Processing fees are non-refundable under any circumstances, including in the event of a subscription refund or money-back guarantee payout. The money-back guarantee covers the subscription amount only, not the processing fee.
Example: A $49.00 Starter subscription will reflect a total charge of $50.91 ($49.00 + $1.72 processing fee + $0.19 rounding). A $99.00 Pro subscription will reflect $102.20. A $199.00 Premium subscription will reflect $205.39.
Contractors who subscribe to a paid plan agree to pay the applicable monthly subscription fee. Subscription fees are non-refundable except as provided in the money-back guarantee: if a Contractor receives zero qualifying leads in a calendar month, they may request a full refund of that month's subscription fee by contacting support@saleslead.com within 10 days of the billing period end.
Lead fees consist of a deposit payable at time of claim and a success fee payable upon winning the job. Both fees are agreed to by the Contractor at time of claim. Failure to pay the success fee after winning a job is a material breach of these Terms and will result in account suspension.
SalesLead currently processes payments via Zelle and other methods as designated on the Platform. All payment confirmations should be retained by both parties.
Contractors agree not to solicit, accept work from, or enter into any direct business arrangement with a Homeowner introduced through SalesLead for a period of 12 months following the introduction, outside of work facilitated through the Platform, without paying SalesLead's applicable referral fee. Violation of this clause entitles SalesLead to pursue damages equal to the greater of $500 or the estimated value of the circumvented transaction.
SalesLead encourages users to resolve disputes directly. SalesLead may, at its sole discretion, offer mediation assistance but is not obligated to do so and will not act as an arbitrator. SalesLead's decision in any platform-level matter (such as account suspension) is final.
Users may not: submit false or misleading information; harass, threaten, or abuse other users; use the Platform for any unlawful purpose; attempt to circumvent Platform fees; post or transmit spam or fraudulent content; or use the Platform to solicit users for competing services.
SalesLead may suspend or terminate any account at any time for violation of these Terms, fraudulent activity, receipt of verified complaints, or any behavior that SalesLead determines is harmful to users or the Platform. Terminated users are not entitled to refunds of fees already paid.
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration on an individual basis. Users waive the right to participate in class action lawsuits against SalesLead.
SalesLead reserves the right to modify these Terms at any time. Changes will be posted at saleslead.com/terms with an updated effective date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
